2. Website Use

All building designs, drawings, and documentation prepared by Wa Building Design Pty Ltd remain our intellectual property until full payment has been received. Upon payment, the client receives a licence to use the designs for the specific project for which they were created.

4. Services Engagement

Engagement of our building design services is subject to a separate written agreement, which will outline the scope of work, fees, timeline, and deliverables. These Terms & Conditions supplement that agreement. In the event of any inconsistency, the signed services agreement prevails.

5. Client Responsibilities

As a client, you agree to:

• Provide accurate and complete information about your project, site, and requirements;
• Obtain any necessary permits or approvals not covered by our scope;
• Notify us promptly of any changes to your requirements or site conditions;
• Make timely payments as outlined in your services agreement.

6. Limitation of Liability

To the maximum extent permitted by law, including the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law, Wa Building Design Pty Ltd's liability for any claim arising out of or in connection with our services or this website is limited to the amount paid by you for the services giving rise to the claim.

We are not liable for:

• Any indirect, incidental, or consequential damages;
• Loss of profits, data, or business opportunity;
• Delays caused by third parties, including councils, certifiers, or consultants;
• Site conditions, structural issues, or other matters discovered during construction that were not reasonably foreseeable at the design stage.

Nothing in these terms excludes, restricts, or modifies any right or remedy implied by the Australian Consumer Law that cannot be lawfully excluded.

7. Termination

Either party may terminate a services engagement in accordance with the terms of the signed services agreement. In the absence of such provisions, termination requires 14 days written notice. Upon termination, the client must pay for all work completed up to the date of termination.

We reserve the right to terminate or suspend access to this website at any time without notice if you breach these terms.

8. Governing Law

These Terms & Conditions are governed by the laws of the State of Western Australia, Australia. Any disputes arising from these terms or your use of this website shall be subject to the exclusive jurisdiction of the courts of Western Australia.

9. Changes to Terms

We reserve the right to update these Terms & Conditions at any time. Changes will be posted on this page with an updated effective date. Continued use of the website after changes are posted constitutes acceptance of the revised terms.
